Terms of Service
Effective Date: May 6, 2026
Welcome to Palo. These Terms form a binding agreement between you and FI LLC (“Palo,” “we,” “us”) governing your use of the Palo app and related services (the “Service”). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.
If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old to use Palo. By creating an account, you represent and warrant that you are 18 or older. If we learn that a user is under 18, we will terminate the account and delete the associated data. Palo is designed for adult emotional support and is not suitable for minors.
2. What Palo is (and isn’t)
Palo is a self-help wellness app that uses AI to offer companionship, journaling, mood tracking, and reflection tools for people going through breakups and no-contact.
Palo is not:
- A medical device, licensed therapy service, or a substitute for a licensed mental-health professional.
- A provider of medical, psychological, legal, or financial advice.
- An emergency service.
By using the Service, you acknowledge you understand this and agree that Palo is not a replacement for professional care.
3. AI-generated content
Palo’s chat, Truth Garden responses, and memory summaries are generated by artificial intelligence, including large language models from Anthropic, OpenAI, and Groq. AI output can be inaccurate, incomplete, or inappropriate. We do not guarantee the accuracy, safety, or suitability of any AI response. You are responsible for how you act on anything the AI says.
4. Your account
You are responsible for:
- Providing accurate information during signup.
- Keeping your account credentials confidential.
- All activity under your account.
You may delete your account at any time from Settings → Delete Account.
5. Subscriptions and payments
Palo offers optional auto-renewing subscriptions (Monthly and Annual plans) sold through the Apple App Store.
- Billing: Apple processes all payments. Your Apple ID will be charged when you confirm the purchase and at the start of each renewal period.
- Auto-renewal: Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period.
- How to cancel: Manage or cancel your subscription in your iPhone’s Settings → [your name] → Subscriptions. Deleting the Palo app does not cancel your subscription.
- Refunds: Refund requests are handled by Apple under Apple’s policies. You can request a refund at reportaproblem.apple.com.
- Price changes: We may change subscription prices. Any change takes effect on the next renewal after we notify you.
- Free trials: If a free trial is offered, unused portions are forfeited if you purchase a subscription before the trial ends.
6. Your content
You retain ownership of everything you write, record, or create in Palo (“Your Content”). By using the Service, you grant us a limited, worldwide, royalty-free license to process, store, and display Your Content solely to provide and improve the Service for you. We do not claim ownership, sell Your Content, or use it to train AI models.
7. Acceptable use
You agree not to:
- Use the Service for anything illegal, abusive, or harassing.
- Impersonate another person or misrepresent who you are.
- Try to reverse-engineer, scrape, or attack the Service.
- Upload malicious code, spam, or other harmful content.
- Use the Service to harm yourself or others, or to plan harm to yourself or others.
- Use the Service to give medical, legal, or professional advice to others.
- Bypass, disable, or circumvent any security or access controls.
We may suspend or terminate accounts that violate these rules.
8. Our intellectual property
The Palo app, logo, Truth Garden concept, mascots (including Mochi), and underlying software are owned by FI LLC and are protected by copyright, trademark, and other laws. We grant you a personal, non-transferable, non-exclusive license to use the app for its intended purpose. No other rights are granted.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI RESPONSES WILL BE ACCURATE OR APPROPRIATE FOR YOUR SITUATION.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FI LLC AND ITS OFFICERS, AGENTS, AND EMPLOYEES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, REVENUE, OR PROFITS. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID PALO IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) USD $50.
Some jurisdictions do not allow these limitations, so they may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless FI LLC from any claim, loss, or expense (including reasonable attorney fees) arising out of your use of the Service, Your Content, or your violation of these Terms.
12. Termination
We may suspend or terminate your access to the Service at any time for violations of these Terms or for any other reason at our discretion, including inactivity. You may stop using the Service at any time by deleting your account. Sections that by their nature should survive termination (including 6, 8, 9, 10, 11, 14, 15) will survive.
13. Changes to the Terms
We may update these Terms from time to time. If changes are material, we’ll update the “Effective date” above and notify you in-app or by email before the change takes effect. Continued use after the effective date means you accept the new Terms.
14. Governing law and disputes
These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in that state, and you consent to that jurisdiction.
If you are a consumer residing in the European Economic Area, the United Kingdom, Switzerland, Brazil, or another jurisdiction with mandatory consumer-protection laws, nothing in these Terms restricts your right to bring claims under the laws of your country of residence or in the courts of your country of residence. Where local mandatory consumer-protection law conflicts with these Terms, that local law prevails.
15. Consumer rights for users outside the United States
Nothing in these Terms limits the rights you have as a consumer under the mandatory laws of your country of residence.
EU / EEA / UK / Switzerland — right of withdrawal. Consumers in these regions ordinarily have a 14-day right to withdraw from a digital service contract. Because Palo is a digital service that begins delivery immediately upon subscription, by purchasing a subscription you expressly request that performance begin during the withdrawal period and acknowledge that you lose the right of withdrawal once performance has begun. You may still cancel future renewals at any time as described in Section 5.
Statutory warranties. Where required by local law, you are entitled to statutory warranties that cannot be excluded by these Terms. Sections 9 (Disclaimers) and 10 (Limitation of liability) apply only to the extent permitted under your local law.
16. Apple-specific terms
If you use Palo on iOS:
- These Terms are between you and FI LLC, not Apple. Apple is not responsible for the Service or its content.
- Apple has no obligation to provide any support or maintenance for the Service.
- Apple is not responsible for any product warranties, claims, or third-party intellectual-property claims. If Palo fails to conform to any warranty, you may notify Apple, and Apple will refund the purchase price (if any).
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
